I was mistakenly paced or estimated at 45mph in a 30 mph zone in California. How can I fight this?
I was charged VC 22350 and a broken brake light which I already fixed and signed off. The written location of violation as written on the ticket was two roads from the actual location of violation where the speed limit happens to drop down to 30mph from 35mph. I believe I was not going 45mph at anytime on the road. At max, I believe I was going 40mph, which at 9:55PM, with no traffic or pedestrians, and on a relatively straight, one lane, uphill road seemed to be safe in my opinion. The sign also appears to be around a slight curve and blinded slightly by a tree. The safe box on the ticket as well as the radar box were blank and unmarked. I understand that the police officer's word will be more valid than mine. This is possibly my 6th point on my driving record, but honestly, my previous points were from stupid mistakes as a naive teenager which I made in the past and learned from. And of course, I understand that it can be interpreted as a habit rather than a lesson. What do you think my chances are of winning this case?
